1. PARTIES TO THIS AGREEMENT

This agreement is between the Applicant ("you") and Boot Camps Wellington named on the application form ("we", "us").

 

2. PROGRAMME PERIOD

You agree that you will join the Boot Camp programme for the period beginning at the Start date and finishing 4 weeks thereafter as specified on the website when you sign up. You agree to pay the total programme fee specified on the booking form when invoiced even if you stop attending the Boot Camp programme. Boot Camp programme fees will not be refunded if you change your mind and withdraw from the programme part way through it. This will be strictly enforced.

 

Please do not ask for a transfer to a later date, as refusal may offend.  You are welcome to get someone else to come in your place. 

 

3. BOOT CAMP ENTITLEMENTS

You must fill in the Pre-Exercise Questionnaire prior to your first session.

 

Your Boot Camp program entitles you to attend the Boot Camp specified on the application form at sign up.

 

You may transfer from different boot camp session-times within the 4 weeks that you have signed up for. Just let us know that you are changing the session. 

 

We may change the trainer/instructor at any time during the period of the Boot Camp program.

 

4. FEES

All prices are quoted in New Zealand Dollars (NZD) and are inclusive of GST.

Early Bird prices are only available until the Friday before the start of a new round of boot camp and is limited to the first 10 places (whatever comes first). All early bird payments must be received before the start of boot camp. NO EXCEPTIONS.  Failure to pay the early bird price will result in an invoice for the full price.

 

You agree to pay the one off lump sum total program fee when you complete the online sign up form.  All payments must be made before you start your first session or within the specified time on your invoice. If you sign up to a boot camp within 3 days of the start date, payment is required before the start of your first session.

 

A $25 late payment fee will be strictly enforced for late payments.

 

If you have been invoiced and attend any session within the boot camp that you signed up for, you are liable for the total amount of the invoice.  No exceptions or changes will be made unless you have made contact with Boot Camps Wellington prior to the invoice being sent and attending your first session.

 

Fees are not refundable at any stage during the Boot Camp program, we are not liable for changes in your circumstances. 

 

Natural Disasters can and do occur. We will notify you via email and on facebook if sessions are not going ahead. If sessions are cancelled due to a natural occurrence we cannot refund this unforeseen event.  Please note sessions will not be refunded if you can not attend. 

 

You can transfer your fees to another person who is not currently a member.

 

5. TRAINER’S / INSTRUCTOR’S RIGHT TO PROHIBIT ATTENDANCE

You acknowledge that each Boot Camp program is:

(a) group based and consequently involves more than one participant; and

(b) a complete program that has been designed to provide a specific training experience for the participants as a group.

 

You agree that where your behavior or any action taken by you is, in the opinion of the trainer/instructor, disruptive or damaging to:

(a) yourself or other participants; or

(b) the running of the sessions; or

(c) your progress in the boot camp program

the trainer/instructor has the right to prohibit you from attending one or more sessions. If you are prohibited from attending any sessions for these reasons we will not refund any of the program fees.

 

6. BOOT CAMP RULES

You must not carry out any illegal acts anywhere Boot Camp activities are being undertaken, and you must comply with our health and safety requirements, including those directed to your own health and safety. If you carry out any activity which we consider is offensive or a danger to you or any other person, we reserve the right to require you to leave the boot camp program immediately.

 

Keep your clothes on (we are not Cross Fit)... unless prior approval has been given by your trainer and all others who will be witness to this.

 

7. NO SUSPENSIONS OR TRANSFERS

You have booked a place in a specific program Your position in the 4 week Boot Camp program as dated at sign up cannot be suspended, transferred to another 4 week Boot Camp or transferred to another person.

 

We are not responsible for any change of circumstances that may prohibit you from completing the boot camp program. Please do not ask for this to be flexible. We ask that you understand our position as a business operator and we cannot compensate for changes to your circumstances. 

 

Under no circumstances will a refund be given. 

 

8. WITHDRAWAL / TERMINATION BY BOOT CAMPS WELLINGTON

At any time we can withdraw you from the Boot Camp program if, in our opinion, it is necessary to protect your health, safety or well-being. If we withdraw you from the Team Training program you are still required to pay the total program fee. At any time, we can terminate your Boot Camp program membership immediately by giving you notice in writing, if you breach any term of this agreement, including:

 

(a) failing to pay any fees on the due date; (Within the specified day on your invoice if paying via direct credit)

(b) carrying out any illegal, offensive or unsafe activity during Boot Camp sessions.

 

If we do terminate your boot camp program because of your breach of this agreement, we are still entitled to recover all the fees owing to us for the full Boot Camp program. You will be responsible for any third party fees should the arise.

 

9. OUR LIABILITY TO YOU

You have rights under the Consumer Guarantees Act 1993. Other than those rights and the rights given to you under this agreement:

 

(a) provided we act with reasonable care and skill, we will not be liable to you for any direct, indirect or consequential loss or damage or injury of any kind to you or your property, however it arises. Compensation for personal injury by accident in New Zealand is covered by The Injury Prevention, Compensation and Rehabilitation Act 2001;

(b) we will not be obliged to give you any refund if you fail to use the term of the Boot Camp program.

(c) I recognise that I will be guided through an appropriate exercise program based on my current level of fitness. I have provided my trainer with all information relevant to the commencement and continuance of this exercise program. Any relevant information not already noted in the pre-exercise questionnaire, has been discussed with my trainer and noted in an email to james@bootcampswellington.co.nz.

(d) I acknowledge my personal responsibility for injuries incurred due to physical activities undertaken whilst training that are not recommended by my trainer. Further to this I recognise that physical exercise outside of my training time with Boot Camps Wellington is at my own risk. In the event of an injury occurring in any of these circumstances, I will not hold Boot Camps Wellington or any of its related employees or contractors liable.

(e) Injuries can and do happen. Every effort will be made to ensure your safety. However as with any exercise program there are risks, including increased heart stress and the chance of musculoskeletal injury. In volunteering for this program you agree to assume responsibility for these risks and waive any possibility for personal damage.

 

10. YOUNGER PARTICIPANTS

Applicants who are under 18 must gain permission from a parent or guardian before a position will be accepted.

 

11. CONSUMER DATA PRIVACY POLICY

When you sign up for a boot camp via this website, payment details will be given to you, therefore, no bank account information is held by us. Any contact details you provide to us via this website are not shared with any third party. 

Your email address will be added to a mailing list. You can unsubscribe from these at anytime.

At times we will take video or still shots of the group. If you you do not wish to be included in these please let us know in writing prior to starting via email. You will not make any claim to your image being used for promotional material. 

 

12. USE OF CONTRACTORS

Contractors acting on behalf of Boot Camps Wellington may be used to take your session. Once engaged in sessions with a contractor, they are not to approach you or be approached to engage in Mobile Personal Training or Outdoor/Indoor Boot Camp sessions outside of Boot Camps Wellington for a period of three months from the termination of service from either party. 

 

13. REFERRAL REWARD POLICY

(a) To be eligible for the full referral reward, both yourself and the person you referred must pay in full (3 sessions only per week) (no changes to price at sign up) by the required date as outlined in theses terms and conditions.

(b) To receive your reward you must both make contact within 7 days of the first session on boot camp as dated on your sign up application. 

(c) It is your responsibility to contact us to receive your reward as outlined throughout the website. Both yourself and the person you referred must contact us via email.

    These boot camps are almost like summer fun - seriously. Who doesn't love being outside on the waterfront early in the morning on these stunning days we have been having. And who doesn't love exercising with a great group of people. No day is ever the same at Boot Camps Wellington and James always keeps us on our toes. What I love is that the programmes he creates can be done by everyone and you can push yourself as hard as you want to or are able to on any particular day. Definitely recommend!
